TENANCY DEPOSIT COMPENSATION CLAIMS
Landlords who take a tenancy deposit may be required to protect the deposit in an authorised scheme and provide the tenant or contract-holder with the required information within the applicable time limit.
A claim may arise where a deposit was not protected, was protected late or the required information was not properly provided.
Depending on the circumstances, the court may award compensation of between one and three times the amount of the deposit. The court may also make an order concerning the deposit itself.
We can review the tenancy or occupation contract, deposit protection records, prescribed or required information and other available evidence before advising on whether a claim may be available.

POSSESSION AND EVICTION
A landlord who wishes to recover possession of residential property must follow the correct legal procedure.
The procedure will depend upon matters including whether the property is in England or Wales, the nature of the tenancy or occupation contract, the reason possession is sought and whether the relevant statutory and contractual requirements have been satisfied.
We can advise landlords on notices, possession proceedings and enforcement where the occupier does not leave voluntarily.
We can also advise and represent tenants or contract-holders who have received a possession notice or are facing possession or eviction proceedings.
Where proceedings have already been commenced, we can review the claim, the notice relied upon and the available evidence and advise on the appropriate response.
RENT ARREARS AND RECOVERY
Rent arrears can result in financial loss for a landlord and may also lead to possession proceedings.

Where a money judgment is obtained, further enforcement action may be required if payment is not made voluntarily.

Where appropriate, we prepare or review relevant correspondence and notices and set out the legal position to the other party.
We consider the available evidence and seek to resolve the dispute where appropriate. If proceedings are required, we prepare the necessary documents and evidence.
Where court proceedings are necessary, we can advise and represent you throughout the relevant process and concerning enforcement where appropriate.
FEES
We offer fixed fees for certain defined landlord and tenant services. Other work may be charged on an hourly basis depending upon the nature and scope of the work required.
For some tenancy deposit compensation claims, alternative funding arrangements may be available depending upon the circumstances of the case.
